Ill. Federal Judge Dismisses Mirena Lawsuits, Grants Plaintiffs Leave to Amend

ALTON, Ill. — An Illinois federal judge has dismissed two Mirena injury lawsuits against Bayer Healthcare Pharmaceuticals Inc., finding the plaintiffs failed to assert cognizable claims under the Louisiana Product Liability Act.

However, in the Sept. 26 order, Chief Judge David R. Herndon of the U.S. District Court for the Southern District of Illinois granted the plaintiffs leave to amend the claims that are cognizable under Louisiana law.

Louisiana citizens Karen Holt and Brittany Blanchard each had Mirena intrauterine birth control devices inserted in October 2011 and April 2012, respectively. Holt later had surgery to remove a cyst, her right …
