Rust-Oleum Seeks Dismissal from Continental Airline Worker’s Benzene Suit

DALLAS — Rust-Oleum Corp. has moved for summary judgment in a lawsuit brought by a former Continental Airlines employee who claimed that he developed acute myelogenous leukemia as a result of exposure to benzene.

In the Sept. 15 motion filed in Dallas County District Court, Rust-Oleum asserts that although experts testifying on behalf of plaintiff Virgil Hood have provided specific evidence of exposure to products manufactured and supplied by various co-defendants in the case, none of the evidence implicates Rust-Oleum’s products as a cause of Hood’s AML.
