Boston Scientific Seeks Dismissal of Texas Pelvic Mesh Suit Ahead of October Trial Date

DALLAS — Boston Scientific Corp. has moved to dismiss a Solyx pelvic mesh case set for trial next month in the same Texas court where last week a jury awarded more than $73 million for injuries caused by a similar product made by the company.

In a motion for summary judgment filed Sept. 12, Boston Scientific argues that the claims are barred by a Texas law that the defendant says immunizes medical device makers from suit based on a statutory presumption of non-liability for federally regulated products.
