Ind. Appellate Court Affirms Denial of Benefits in Asbestosis Case from Former Eli Lilly Employee

INDIANAPOLIS –– An Indiana appellate court has affirmed the denial of asbestosis benefits to a former Eli Lilly employee, ruling that while the decedent had proven that he was exposed to asbestos at the facility, he had failed to prove that this exposure caused his illness.

In the Sept. 10 opinion, the Indiana Court of Appeals also found that the state Workers’ Compensation Board did not err when it found that the decedent was not a credible witness because his testimony contained “multiple inconsistencies.”
