N.J. Judge Dismisses Case Against Insurer That Reformed Condo Policies After Superstorm Sandy

TRENTON, N.J. — A federal judge in New Jersey has dismissed all claims against a flood insurer that was sued after reforming policies issued on two buildings that it said were incorrectly categorized as apartment buildings prior to being damaged by Superstorm Sandy.

In an Aug. 28 decision, Judge Freda L. Wolfson of the U.S. District Court for the District of New Jersey ruled that the insurer was legally obligated to reform the policies based on the buildings’ status as residential condominiums, thereby subjecting the owner’s claim to coinsurance penalties mandated by the federal flood insurance program.
