Hawaii Court Limits Plaintiff Expert Testimony in Pesticide Exposure Suit

HONOLULU –– A Hawaiian federal court has stricken plaintiff expert testimony in a pesticide exposure suit, saying that since the plaintiffs expressly disclaimed personal injury and environmental claims in the property damage lawsuit, allowing such evidence would lead to juror confusion.
The U.S. District Court for the District of Hawaii issued an order granting the motion to strike on July 31, but issued the instant memorandum on Aug. 26 to explain its decision.
Plaintiffs contend that the Robinson Family Partners leased fields on Kauai to Gay & Robinson Inc., which later leased the land to Pioneer Hi-Bred International Inc.
