Wis. Court Dismisses Claims Against Weyerhaeuser, Owens-Illinois in 2 Asbestos Suits

MADISON, Wis. –– A Wisconsin federal court has dismissed asbestos claims pending against Weyerhaeuser Co. and Owens-Illinois, finding that the state’s workers’ compensation act bars the claims.

In the Aug. 22 opinion, the U.S. District Court for the Western District of Wisconsin further rejected the plaintiffs’ attempts to hold Owens-Illinois liable for its role in licensing technology used in fireproof doors.

Milton and Kathy Boyer alleged in their lawsuit that Milton Boyer came into contact with asbestos-containing fireproofing products while employed at a door manufacturing plant. As a result of the exposure, Milton developed mesothelioma, the plaintiffs said.
