Fla. Federal Court Grants Motion to Dismiss Union Carbide from Asbestos Complaint, Gives Plaintiffs 30 Days to Amend

MIAMI –– A Florida federal court has issued two separate opinions in an asbestos case, finding in part that the plaintiffs had failed to plead their claims with the requisite specificity against Union Carbide.

In a separate opinion also issued on Aug. 1, the U.S. District Court for the Southern District of Florida denied attempts made by Lorillard Tobacco Co. to strike certain allegations in the first amended complaint, saying the language the defendant referred to is not inappropriate.
