N.Y. Federal Judge Denies Motion to Quash Arbitration Panel’s Subpoena

NEW YORK — A New York federal judge has refused to quash a subpoena issued by an arbitration panel seeking a nonparty’s testimony, explaining that it is not within the court’s discretion to determine whether the evidence sought is material to the dispute.

On July 18, Judge Katherine P. Failla of the U.S. District Court for the Southern District of New York explained that once it is determined that the dispute is arbitrable, “procedural questions which grow out of the dispute and bear on its final disposition should be left to the arbitrator.”
