Iowa Judge Allows Failure-to-Warn, Design Defect Claims to Proceed in Diacetyl Popcorn Lung Suit

SIOUX CITY, Iowa –– An Iowa federal judge has allowed breach of implied warranty, failure-to-warn, and design defect claims to proceed in a popcorn lung lawsuit alleging that exposure to diacetyl in butter flavorings led to the development of respiratory problems.

In the July 11 opinion, the U.S. District Court for the Northern District of Iowa ruled that the plaintiffs submitted enough evidence to raise a question of triable fact for each of the claims.

The plaintiffs allege that David Stults developed popcorn lung as a result of consuming several bags of microwave popcorn daily for a number of years. …
