7th Cir. Denies GSK’s Writ of Mandamus in Generic Paxil Suicide Case

CHICAGO — A federal appeals court has refused to compel a lower court to award GlaxoSmithKline summary judgment on claims of negligence, products liability and fraud in a generic Paxil suicide case, ruling that the lower court’s ruling did not constitute a “grave misuse of power.”

The 7th Circuit U.S. Court of Appeals on June 4 denied GSK’s petition for a writ of mandamus compelling the trial court to award the drug maker summary judgment on the basis that it did not manufacture the product ingested by Stewart Dolin, who committed suicide after taking generic Paxil.
