1st Circuit Court Hears Arguments in Beryllium Medical Monitoring Dispute




BOSTON –– The 1st Circuit U.S. Court of Appeals has heard oral arguments relating to Massachusetts' standard for medical monitoring claims in a beryllium dust case asserted by former Raytheon employees.

According to the court’s online docket, the beryllium case was argued on May 5 before appellate judges Judge Juan R. Torruella and Judge Bruce M. Selya, appellate judges and Steven J. McAuliffe, U.S. District judge.

Plaintiffs in two associated cases are suing Raytheon and the company’s suppliers, contending that defendants failed to warn employees at Raytheon’s Waltham, Mass., facility of the hazards of airborne beryllium dust. A second …
