Par Granted Summary Judgment in IPLA Action Involving Cholestyramine Powder

INDIANAPOLIS — An Indiana federal judge has awarded Par Pharmaceuticals Corp. summary judgment in an Indiana Products Liability Act lawsuit in which a woman claimed she found latex glove pieces in Par’s cholestyramine powder.

On May 21, Judge Tanya Walton Pratt of the U.S. District Court for the Southern District of Indiana concluded the plaintiff failed to overcome the IPLA’s presumption that the product was not defective because she did not present evidence that the powder contained the latex.
