DePuy Moves to Exclude Evidence of Recalls in 1st DePuy ASR Bellwether Trial

TOLEDO, Ohio — U.S. District Judge David A. Katz has signed an order allowing the plaintiff in the first DePuy ASR hip implant MDL trial to submit motions in limine under seal to avoid disclosing documents or exhibits subject to protective orders.

Judge Katz entered the order May 13 in the U.S. District Court for the Northern District of Ohio, where he presides over the multidistrict proceedings.

The judge recently re-scheduled trial on claims brought by Faye Dorney-Madgitz from June 3 to Sept. 9, to allow briefing and argument on choice-of-law and other pending and expected motions.
