ATLANTA –– The 11th Circuit will hear arguments relating to whether CERCLA preempts North Carolina’s state statute of repose in the context of injuries caused by exposure to contaminated drinking water at the Camp Lejeune Marine Corps Base.

On Oct. 31, the U.S. Court of Appeals for the 11th Circuit granted the petition for permission to appeal.

In July, the United States asked the U.S. District Court for the Northern District of Georgia to amend a recent order so that the defendant could seek interlocutory appeal of a ruling that found that CERCLA preempts North Carolina’s statute of repose. …
