JPML Separates Claims and Conditionally Transfers Indiana Action to 2 MDLs

WASHINGTON, D.C. - The Judicial Panel on Multidistrict Litigation has separated a Virginia man's Pinnacle and ASR hip implant claims and conditionally transferred them from the implant manufacturer's home state of Indiana to MDLs pending in Texas and Ohio. Foreman v. DePuy Orthopaedics, Inc., et al., No. 3:12-C.A. N. 3:12-00050 (N.D. Ind.).

The JPML issued its conditional transfer order Feb. 8 in MDL 2197 (In re: DePuy Orthopaedics, Inc., ASR Hip Implant Products Liability Litigation) and MDL No. 2244 (_In re: DePuy Orthopaedics, Inc., Pinnacle Hip Implant Products Liability Litigation). _ The panel noted in its order that the lawsuit …
